He was absent without leave in February of 1863, having returned by March, he left again in June. On 20 July 1863 it was reported that he had deserted and was in Hanover County. By order of Colonel Morrison, he was dropped from the role in November. Hanes was arrested in March of 1864. The muster accounts for his presence through the autumn of 1864, and he was paid. On 8 March 1865 he was admitted to Chimborazo Hospital in Richmond, suffering from catarrh.∼CO E
