During a family argument on April 12, 1939, James shot his father Guy with his father’s revolver. After the shooting, Guy wrote the following note: "I hereby request Detectives White & [illegible] to release my son James Nelms from custody as I do not want him prosecuted for shooting me. 4-13-39 Sig. Guy M. Nelms." About 10 months later James was convicted of assault with a deadly weapon and sentenced to 60 days in the county jail, the judge finding extenuating circumstances.

Guy Nelms became a Los Angeles police officer in 1912. By 1939 he was retired and, unfortunately, had become both alcoholic and abusive. He died of heart disease about six months after the shooting, with a bullet wound abscess noted as a contributing factor.

Guy & Elizabeth Nelms had two children: James, and Kathryne, who m. 1) Damon M. Cecil and 2) Roy T. Dalton.
