Will of Jabez Beebe -

"In the name of God Amen - I Jabez Beebe of the town of Howard in the County of Steuben in the State of New York being in tolerable health of body and possessing a tolerable degree of that judgement that nature had furnished me with and calling to mind that I must go the way of all flesh soon And Whereas providence has possessed me with some property and preserved to me a number of children which I consider to be my lawful heirs, I therefore declare solemnly this to be my last Will and Testament and that my property at my decease be disposed of in the following manner - First_ I appoint that a line be struck through my land lying in the town of Howard Steuben County State of New York in the following manner viz:
beginning on the north side of said land at a point on the road leading to Rathbun's sawmill in said town fourteen rods to the Eastward of the east end and edge of the Great Chyle hole on said land so called, thence southerly direct to the northwest corner of the garden at the westerly end of the house on said land, thence southerly to the south westerly corner of said garden so as to intersect the road at the south of said land leading to the Pond settlement - I next appoint that all the land with the appurtenances thereon which I own to the eastward of said line be given to my daughter Eunice wife to Stephen Gano Ferris and to her natural heirs. Thirdly I appoint that all land that I own to the westward of said line be divided between my two sons Jabez Avery Beebe and Charles Perkins Beebe in the following form viz:
the said Charles to have three fifths of said westerly part and said Jabez to have the other two fifths - the division between my two sons to run from north to south said Charles's to lye direct between said Jabez's and the said Eunice's land - and whereas my father Jabez Beebe late of the town of Waterford in the County of New London and State of Connecticut did by virtue of his will at his decease leave with his widow a certain property in land lying in said Waterford for her benefit as long as she should live and at her decease to be divided equally between his three children of which I am one I therefore hereby appoint that whatever my part of said property of said deceased shall be shall be given to my son Cary Latham Beebe or his heirs and that said Cary or his heirs are hereby in my name authorized and empowered to collect and receive my said share of said property of said deceased exclusively to the said Cary or his heirs - and Whereas my son Leonard Beattie Beebe has been helped by me and some of his brothers to a considerable amount to help him on in his studies and other expenses toward obtaining his diploma as a physician and whereas the said Leonard has been absent from me and I have not heard from him for a number of years and now suppose him dead but in case said Leonard should be alive at my decease I order that my children to whom I have given my landed property in the Town of Howard aforesaid be obliged to pay to the said Leonard twenty dollars in proportion as each have received in value in said property within two years after his application to them for it after my decease - and Whereas my son Joseph Ledyard Beebe has at one time received of me in money one hundred dollars together with several other considerations in property therefore I appoint that five dollars be paid to the said Joseph by those children of mine who are heirs to my property in said Howard in proportion as they have received of said property within one year after my decease inasmuch as the said Joseph agreed in consideration of the said one hundred dollars to forbear forever all demands on my property after my decease - I also order that whatever movable property of mine of every kind be equally divided between my son Charles and my son in law Stephen G. Ferris they being equally bound to pay my funeral charges and other just debts that I owe to any person at my decease - And whereas there is a nursery of apple on my said land of which two thirds belong to my son Jabez A. Beebe on the south side, the other third on the north to myself, my part at my decease to be equally divided between my son Charles and my son in law Stephen G. Ferris to be executors to this my last Will and Testament so far as it respects all matters herein contained except the property hereby given to my son Cary L. Beebe which matter he or his heirs is to see to and settle independent of all others executors each executor to act with equal authority and each to bear their proportion of expenses.
And now in the fear of God I declare this to be my last will and testament and declaring all other wills and testaments of mine to be null and void - Given under my hand and declared by me to be my last will and testament this second day of July at Howard, County of Steuben State of New York in the year of our Lord Christ 1828.
