Herbert's first wife was Bertha Miriam Paxton, the daughter of Hugh Paxton and Paulina Smith. They had married at Wheatland, MO on February 12, 1902. To this union were born the following children: Myrtle, Ted, Orrie, Anna, Walter, Kenneth and Elmer.
Bertha died March 9, 1934 from "complications of asthma" and is buried at Wheatland, MO.
