"An estate valued at well on toward a million dollars is disposed of in the will of Edward C. Hegan, which was admitted to probate yesterday in the County Court by Acting Judge Edward Meglemry. All of the estate goes to his wife and to his brothers and sisters and their children. Exceptions to his relatives as beneficiaries include his brother, John D. Hegan, and a nephew and niece of his late brother, Samuel W. Hegan - the niece being Alice Hegan Rice, the author- and another nephew, Garnett Hegan, to whom nothing is bequeathed.


Provision is made for the payment of an annuity of $2,500 to his wife, Mrs. Mollie E. Hegan, and the use and proceeds of the testator's farm of 150 acres near Eastwood on the Shelbyville pike for her also. The will is dated July 6, 1909, and is witnessed by Adelaide C. Pollei and Harry Kendall. Dr. W. B. Netherland, Francis H. Miller and Robert N. Miller are named as executors, no bond or inventory being required by the terms of the instrument.


Subject to the annuity mentioned to the life interest of the widow in the farm and the payment of debts, the testator divides the estate into five equal parts, bequeathing an undivided one-fifth interest each, as follows;


To Mary A. Hegan, his sister.


To Mrs. Kate Hegan Miller, his sister.


To W. H. Netherland, Martha S. Netherland and Margaret Netherland Dulaney, the children of his deceased sister, Margaret E. Netherland.


To Mrs. Theodosia L. Hegan, widow of his brother, Frank Hegan, and their children, Eugenia Hegan, Mary Hegan Hensen and Florence Hegan Polton, all of Chicago.


To Florence Hegan, Chesterfield Hegan and Marguerite Hegan, children of his brother, John D. Hegan.


Included in the will is the following paragraph:


'In this will I have in mind that I have a brother, John D. Hegan, and a nephew and niece, children of S. W. Hegan, for whom I have made no provision , but as I gave my brother, S. W. Hegan, during his life his portion, I do not desire to make further provision.'


In the section of the will in which Mr. Hegan directs that a fifth of his estate be divided among Mrs. Theodosia L. Hegan and three of her children, Eugenia Hegan, Mrs. Florence Hegan Polton and Mrs. Mary Hegan Hensen, he added this sentence:


'No part of my estate shall go to my nephew, Garnett Hegan, who should be able to maintain himself.'"
