The chancery petition ("bill of complaint") transcribed below lists the following children of Heinrich (Henry) and Mary Kibler:

Heinrich (Henry) and Mary married 1759, Shenandoah Co, Va. The above ancestry.com dates for deaths of Henry and Mary are unconfirmed. There is dispute on whether Mary died in 1799, but she did survive her husband. There is also dispute on Mary's maiden name.

The LVA Chancery Index has two Shenandoah County cases dealing with the estates of Henry and Mary: Index numbers 1801-012 and 1812-008 (below). (Index year is not the year the case began--as is modern practice--but the year the case ended). Under then Virginia law, a surviving widow had a dower right by law that trumped the rights of child heirs, so a widow's omission from a case dealing with a husband's estate could indicate that she predeceased him.

To the Court of Shenandoah County now sitting in chancery: Respectfully complaining Your Orator & Oratrix Lewis Pence and Barbara his wife late Barbara Kiblar, one of the daughter heirs at Law & distributees of Mary Kiblar dec'd, sheweth to the Court:

That the said Mary Kiblar hath lately departed this life intestate, leaving two Negroes, a number of debts due by bonds & notes, a considerable sum in cash, and a considerable quantity of household & kitchen furniture, and leaving--

-- Adam Kiblar,
-- John Kiblar,
-- Martin Kiblar,
-- Philip Kiblar,
-- Molley [Kiblar] now the wife of Jacob Baker, and [2]
-- Your Oratrix Barbara [Kiblar Pence],

her children, heirs at Law and distributees. And Your Orator & Oratrix sheweth to the Court that the said Adam Kiblar, John Kiblar, Martin Kiblar, Philip Kiblar & Jacob Baker & Molly his wife (whom he prays may be made Defendants to this his Bill) have taken possession of the said Negroes and all the other property of the said Mary Kiblar dec'd, and keep the same without administering or giving any account thereof, or letting Your Orator & Oratrix have any part thereof, but refusing to give them anything altho. they well know Your Oratrix is justly entitled to an equal share of all the said property.

All which actings and doings of the said def'ts are contrary to equity and good conscience, & for as much as your Orator & Oratrix are remediless by the rules of the Common Law, but only & properly relievable in a Court of Equity where matters of this sort are properly Cognizable and relievable. To the end therefore that the said Def'ts may be compelled to render a fair & just account of the said property upon their corporal oaths, and fully answer the premises before mentioned. Let them say whether Your Oratrix is not one of the daughters of the said Mary Kiblar dec'd? What property she left & who have had possession of the same. And that the said Def'ts may be compelled to make a fair and equal division of the said property with your Orator & Oratrix. And that Your Orator & Oratrix may have such relief in the premises as to the Court shall seem just.

Mary is thought to have been born about 1745 in Germany and died sometime after 8 Oct 1799 in Shenandoah County, Virginia. She married Henry Kibler about 1759 in Germany. Their first three children were born in Germany, the rest in Virginia. They are my 5th great grandparents through TWO of their sons, Adam and Philip.
