According to his death certificate, he was the son of James McClaugherty and Rhoda Peck, and was married at the time of his death. His death certificate gives his place of birth as Seguin, Guadalupe County, Texas, but in census records his place of birth is consistently given as Virginia. In his Confederate pension application from 1914, he gave his birthplace as Giles Co., Virginia. The informant on his death certificate was H. T. McClaugherty.

John's middle name is spelled a variety of ways. The name Hurk, above, is as on his death certificate. On the death certificates of two of his children, the name is spelled
as Herkansas and Hyrkanass, and on his wife's Confederate pension, she gave his middle name as Hyrk, a spelling also used in the 1880 census.
