He was arrested February 25th, 1864 and returned to Indianapolis, IN for disposition; while awaiting the results of the court proceedings, he escaped the Guard House. Although found guilty in absentia, no sentence was passed; most likely because his regiment was already mustered out.
"Respectfully returned to the Commanding Officer District of Indiana. The recommendation of Major Burnett, Judge Advocate Northern Department is approved and the accused will be forwarded as provided for if he should be arrested."
