James Burnham had reached age 71, when he died in the winter of 1862. He was a brickmason who had married to Abigail Noble in 1820. They had at least 6 children together who are found between the ages of 5 and 21 in the 1850 census for Portland. Abigail survived him by 20 years and was buried at Western Cemetery. One of their sons, Henry, is there as well.

James' grave at Eastern Cemetery is no longer marked with a gravestone, and his exact plot location is not known. It is possible that since his wife and at least one son are at Western Cemetery, he was among the hundreds who were moved out of Eastern Cemetery in the latter half of the 1800s (though his burial record is at Eastern, not Western).
