Also the script letter [f] for [s] has been transcribed as [s]. (xx) is entered for items scratched out or blotted. The Will is recorded beginning at the bottom of page 31 in volume 4 of the Dukes County (Mass.) Probate Register, entered by the Dukes County registrar of Wills.]

In the Name of God Amen. I Abner West of Tisbury In the County of Dukes County In the Province of the Massachusetts Bay In New England, Beeing Indisposed in Body But of a Sound and Disposeing Mind: Considering the Certinty of Death the uncertinty of the times and thinking it my Duty to Sett my House in Order before my Death; Do make and Ordain this my Last Will & Testament in manner following.- First I Humbly Committ my Soul to God who gave it me, and my Body I Committ to the Earth to be Decently Buried, and as Touching my worldly Goods, I Dispose of it in manner following viz ---

Imprimus: I Give & Devize unto my beloved wife Jane, The use & Improvement of the Westernmost half of my Dwelling House in Tisbury aforesaid During her naturall Life and also the use & Improvement of all my Personal Estate, Except what I shall hereafter Dispose of in this my Last

Will, Dureing her Naturall Life (xx) I allso Give and Devise unto my said Wife her Heirs and Assigns for Ever four fifths of all the Land that I shall Dye Seized off in Tisbury aforsd. Provided that my sons Elisha West & Peter West shall Refuse to pay after my Decease according to the Devise in this Will A Reasonable Part of an Annuall Rent which they my Two Sons are obliged to pay to mee Anually if I (xx) am then Living now for as much as there may be justly Due to me a Considerable part of sd Annuall Rent according to the true Intent of the Obligation Given to me by my said Two Sons and yet I not living and so Part of the Rent not Recoverable in Law from a beginning of a year untill my Death, now if they my sons shall refuse to pay so Reasonable Part as aforesd, Then my Will is that my sd Wife shall have the four fifths of my Land as aforsd: But on my sd Two Sons Complyance then my Will is that my said Sons shall have the above mentioned four fifths of my Land mentioned to be given to my sd Wife according as I shall Dispose hereafter. ---

Item. I Give & Devise unto my son Thomas West one fifth Part of all the Land that I Dye Seized of in Tisbury aforsd To Him his Heirs & Assigns for Ever ----

Item. I Give and Devise unto my Son Elisha West His Heirs & Assigns for Ever Provided he pay his Part of the Annuall Rent, above mentioned, Three fifths of all the Land I Dye Seized off in Tisbury aforesd it being as Well his own part as also the parts of his Bretheren Silas & Stephen which he has purchased of Them.

Item. I Give & Devise unto my Son Peter West His Heirs and Assigns for Ever Provided he Pay his Part of the above mentioned Annuall Rent One fifth Part of all my Land wch (which) I may Dye Seized of in Tisbury aforesd. - -

Item. I Give & Devise unto my Daughter Jane four Pounds Lawfull Money, Two Pounds to be paid her by my son Thomas & Two Pounds by my Son Stephen in one year after my Decease. -

Item. I Give & Devise unto my Daughter Elizabeth Daggett four Pounds Lawfull Money to be paid her in one year after my Decease by my Sons Elisha & Peter equally.-

Item. I Give unto my sd Daughter(s) Jane & Elizabeth all my Personall Estate after the Death of my Wife Except what I have hereafter given in this my Last Will To them their Heirs and Assigns for Ever. -

Item. I Give & Bequeath unto my Son Stephen & to his Heirs & Assigns all my Wearing Apparel.

Item. I Give unto my Grand Son Peter Daggett my Gun. -

Item. I Give unto my Grand son Silas West & to his Brothers & Sisters Seven Shillings out of my Estate. -

And Lastly I Nominate and Appoint my Beloved Wife Jane Executrix of this my Last Will and Testament, Hereby Disallowing all former Wills by me made, Declaring this to be my Last Will and Testament. Signed Sealed & Declared this 9th Day of October An. Dom. 1755.
