Roy Agee was the son of Mary Elizabeth Thornton and John Agee Agee, both of Missouri. His parents met out in Yamhill County, Oregon. Mary emigrated to Oregon in 1865, and John, in 1852 . After they married, they moved to Douglas County in 1868. Roy's siblings were: Leetia (died young), Otto, Lucretia (Ellison), Theodosia (Leake) , John, Zopher, Emma, Owen, Ray, Roy, Kathyrn (Stephens), and Bertha (Chapman).

Roy Agee married Grace Brown on June 24, 1908. She was the daughter of Samuel H. and Rebecca F. Brown and granddaughter of Priscilla and Henry G. Brown, early pioneers of Elkton, OR. They had two children, Morris L. (died young) and Donald.

Roy attended San Francisco Business College and began teaching at age seventeen. He was the County Clerk for Douglas County for twenty four years.
