His military record indicates he was enlisted as a Private by Captain Alexander Jordan for the 26th Regiment of Virginia Volunteers, but this unit was too large and was being reorganized. Captain Jordan commanded Company E, 4th Virginia Heavy Artillery, later to become Company E, 34th Virginia Infantry. The 34th was reorganized after F.J. Rusher had died. Private Rusher was discharged by order of Surgeon General Moore on 31 Oct 1861, having been hospitalized for some unknown cause at Richmond's Bellevue Hospital. He was returned home after having been paid for two months and three days of military service. While he is listed on the roster of Company E, 34th Infantry (as transcribed in the Virginia Regimental Histories Series), he should, in effect, be regarded as having served in Company D, 26th Virginia Volunteers.
