In 1870 he became the first judge of the Eighth Circuit, US Circuit Court of Appeals. He resigned in 1879 to become Professor of Law Columbia University in New York and a lecturer at Yale. He authored many law books, which were regarded as authority. He was leader of the bar in New York, and considered one of the most profound jurists of the American bar. The Historical Society of the United States Courts in the Eighth Circuit, Court of Appeals Branch, annually awards five hundred dollars in his name to the University of Iowa law student who submits the finest paper dealing with legal history or jurisprudence.
