John WARNER wrote his will 23d 5m 1584 at Great Waltham, Essexshire, England. It was probated 9d 9m 1584. His will mentions his wife Margaret (whose maiden name is not known) whom he made sole executrix and their children Edward, Andrew, Thomas, Margery, Elizabeth, Margaret, daughter Johan (which would now be spelled Joan), Thomas SAWARD and Xpian CASSE (of whom no relationship is given but since the were to be paid immediately upon John Sr.'s death perhaps they were owned money by him), their grandson Thomas WARNER who was the son of their son John, and the three children of his daughter Mrs. EMMERSTON: Ursula, John, and Agnes (all surnamed EMMERSTON). Witnesses were Richard POND, Thomas BLOWER, and [his son] John Jr. WARNER.

As the will is read it is noticed that the sons are mentioned in this order: Edward, Andrew, and John Jr. Edward's inheritance was to be paid within five years of John's Sr.'s death and Andrew's within six years. However Edward and Andrew were each named by their father as heir to each other's legacy. Given that John Jr. was mentioned as being the father of the grandson Thomas WARNER, this would suggest that John Jr. was the eldest son even though the will does not specifically state such. Daughters Margery, Elizabeth, and Margaret were to each receive their inheritance at the sooner of the time of their marriage or at ages 26, 26, and 21 years respectively. Daughters Elizabeth and Johan were to each be the others heir if either one died before the payment of the legacy. Grandson Thomas WARNER was to be paid his legacy once he reached the age of 10 yrs.
