Married 1st Permelia May Mccurdy on 11 October 1874 in St Louis, Gratiot, Michigan (1849 - 1885). They had three children: Frances Iney Phinisey (1875 - 1956); Claudia Lee Phinisey (1878 - 1879); and Grace W Phinisey (1882 - 1953). After the death of his first wife, Theo, who was working as a photographer in central Michigan, married Eva Estelle Chambers (1876 - 1944). They had three children: Ora (1896 - 1899) who died as a small child; Ora's twin sister Ova Beryl Phinisey (1896 - 1922); and Arthur Guy Phinisey (1901 - 1968).
