Humbly complaining sheweth unto your worship that THOMAS APPLING, late of this County, departed this some time within the year intestate, seized and possessed of a tract of land lying on the waters of Jonathan's Creek in said County containing by estimation nine hundred and forty three acres and that he left neither widow nor children him surviving that RICHARD BLANKS, JAMES BLANKS, THOMAS BLANKS, and ELIZABETH HESTER in whose right the said Frank and Elizabeth Hester claim are the children of MARY, sister of said THOMAS APPLING, decd., who intermarried with JOSEPH BLANKS and is since deceased as is also her said husband and that they are the nearest relations of the whole blood of said intestate.
Your Petitioners further shew that JOHN PURYEAR, ROBERT PURYEAR, WILLIAM PURYEAR, and SALLY ROYSTER in whose right the said WILLAM and SALLY ROYSTER claim are the children of the mother of the said THOMAS APPLING by her marriage with WILLIAM PURYEAR, deceased., and claim as being nearest of kin in the half blood. That ELIZABETH SMITH, widow of THOAMS SMITH, deceased, PEGGY BRADSHAW, widow of JOHN BRADSHAW, deceased, and MARTHA JOHNSON in whose right REUBEN and MARTHA JOHNSON, claim are the daughters of the mother of the said THOMAS APPLING by her marriage with CLEMENTS and claim as being also next of kin of the half blood. That DOLLY TUCKER, in whose right JOEL and DOLLY TUCKER claim, ELIZABETH TUCKER in whose right the said ROBERT and ELIZABETH TUCKER claim, and ANNA CLEMENTS are the children of WILLIAM CLEMENTS, deceased., who was also a son of the mother of THOMAS APPLING, decd., by her marriage with CLEMENTS is aforesaid and if alive would be equally entitled with the said ELIZABETH SMITH, PEGGY BRADSHAW, and MARTHA JOHNSON, and that JOEL TUCKER and DOLLY his wife; ROBERT TUCKER and ELIZABETH his wife ; and ANNA CLEMENTS are entitled to that portion of such lands which should have descended to their father had he been living.
Your petitioners further state that a suit was instituted by the claimants of the half blood against those of the whole blood for the purpose of having the land aforesaid equally divided among them all-which suit was compromised the legatees by agreeing that it should be so divided. Wherefore, your petitioners pray worship to appoint five commissioners for the purpose of laying off land and allotting to your Petitioners the parts and shares to which they may be respectively entitled according to the provisions of the acts of the General Assembly in such case mad and provided and that they report under their hands and seals - And as the Defendants reside out of the State, your petitioners pray that notice of the intention of the Petitioners to have the said land divided by given public advertisement at the Court House door and in the Raleigh (unreadable) Gazette for six weeks successively for the Defendants to come forward and show cause if any they whey the said land shall not be divided according to the prayer of the Petitioners and that such relief may be afforded as the nature of their may require and as in duty bound will every Pray.
