On March 8, 1862 he was enlisted by Robert McLain in Enterprise Mississippi as a private in Company B, 37th Regiment Mississippi Vols. On July 6, 1863, after being captured at the Battle of Vicksburg, he signed the Loyalty Oath and was released.
After Lucy's death, he then married Francis (Fannie) Roseberry. To this union was born two sons, Charley B Ivey
