At a Surrogate Court held at the Surrogate office in the Village of Cherry Valley in and for the County of Otsego, on the 22nd day of June A.D. 1841. Present James Brackett, Surrogate, Benoni H. Marks, Executor named in the last will & testament of John Garrat late of the County aforesaid, deceased, appeared before the said Surrogate and presented said Will for probate and made proof that said deceased died at Burlington in the said County, on the 21st day of May 1841, leaving real & personal Estate in said county. And that the said deceased left the following heirs at Lat to wit: Nancy Davison, wife of Peter J. Davison, & Horatio Garratt both of Sherburne in the County of Chenango; Ann Delocia Marks wife of Benoni H. Marks, Louis Garratt the widow of said deceased, Paulina Garratt, Lucia Garratt; all of Burlington in the County of Otsego. John W. Garratt , also the general Guardian of Ezra Garratt of Burlington. Zachariah C. Garratt and Mary Ann Vaughn, wife of James D. Vaughn of Richfield in said county of Otsego. Robert C. Garratt and Louis Garratt, of Burlington, minors under the age of twenty one years. Whereupon it was ordered by the said Surrogate that Joseph W. Brackett, Esqr, of Cherry Valley aforesaid be, and he thereupon was appointed Special Guardian of the said Infants Robert C. Garratt & Louis Garratt, in manner & form following, to wit: The People of the State of New York, to Joseph W. Brackett of the Town of Cherry Valley in the County of Otsego, Greeting: Whereas, Benoni H. Mark, Executor named in the last will and Testament of John Garratt, late of the Town of Burlington in the County of Otsego, to have the said Will proved, before the said Surrogate, recorded as a will of real & personal estate property. And whereas it has been made satisfactorily to appear that Robert C. Garratt and Louis Garratt are minors, I therefore, the Surrogate aforesaid, pursuant to the power in me vested by the revised Statutes, in pursuance of the order of my Court before made & entered, Do hereby appoint you the said Joseph W.
